IL COORDINATORE E’ GARANTE PER LA SICUREZZA DEI LAVORATORI - La Cassazione: non solo funzioni di coordinamento ma anche di controllo
La Cassazione afferma una ampia responsabilità del coordinatore per l'esecuzione. Varie sentenze lo gravano di una responsabilità di “garanzia” della sicurezza dei lavoratori.
Ciò si desume da diverse sentenze di Cassazione penale: 17631/2009, 38002/2008, 24010/2004, 39869/2004. Tali sentenze sostanzialmente individuano per il coordinatore una posizione di “garanzia” than the safety of workers on site. This is a position of guarantee that is accompanied, in an autonomous and independent to that of other entities established by the rules guards. Ensuring that, while not explicitly established by Legislative Decree 494/1996 and by the Consolidated Security, it appears, or rather can be seen from the cross-reading of the rules.
